We identify issues within a plan’s processes and procedures that are not functioning effectively, and then work with the company to fix those issues by implementing changes to improve efficiency, accuracy, and compliance with regulations, often by suggesting new controls or modifying existing ones.
We help employees with their contributions to a retirement plan that were withheld from their paycheck but were not deposited into the plan by the employer within the required timeframe, essentially meaning the employer is late in sending the employee’s contributions to the retirement fund, potentially violating Department of Labor (DOL) regulations.
Voluntary Fiduciary Correction Program (VFCP) is a program administered by the U.S. Department of Labor that allows plan administrators to self-correct certain violations of the Employee Retirement Income Security Act (ERISA).
Delinquent Filer Voluntary Compliance Program (DFVCP) permits administrators otherwise subject to the assessment of higher civil penalties for failing to file a timely annual report to pay reduced civil penalties for voluntarily complying with the requirement to file an annual report under Title I of ERISA.
The Department of Labor (DOL) and the Internal Revenue Service (IRS) are both organizations that conduct audits, but they focus on different areas. The DOL and IRS share information, and the jurisdiction over 401(k) plans is divided between the two organizations. The IRS has primary jurisdiction over the qualified status of 401(k) plans, while the DOL has primary jurisdiction over fiduciary standards, reporting, and disclosure requirements.
